1. Acceptance of Terms By accessing or using the website flatfeeyyj.ca (the “Site”) and its services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our Site or services.

2. Nature of Service Flat Fee YYJ is a marketing and lead generation platform. We are not a real estate brokerage, mortgage broker, or law firm. We do not provide real estate trading services, legal advice, or financial advice. Our role is strictly limited to:

  1. Providing information and estimation tools (the “Savings Calculator”).
  2. Connecting potential home buyers with third-party, licensed real estate professionals (“Partner Agents”) who have agreed to our flat-fee pricing model.

3. No Agency Relationship Using this Site or submitting your information does not create a client, agency, or fiduciary relationship between you and Flat Fee YYJ. A client relationship is only formed when you enter into a written Buyer Representation Agreement (or similar contract) directly with one of our licensed Partner Agents.

4. The Rebate & Fees

  • Estimates Only: The “Closing Rebate” and “Savings” figures shown on our calculator are estimates based on a standard 2.5% buyer-side commission and typical market conditions. Actual savings may vary depending on the final purchase price, the specific commission offered by the seller, and the terms agreed upon with your Partner Agent.
  • Conditions: Any commission rebate or credit is subject to:
    • The consent of the Partner Agent’s brokerage.
    • Disclosure to all parties in the transaction (including the seller and lender).
    • Compliance with British Columbia Financial Services Authority (BCFSA) regulations.
  • Minimums: As noted on our Site, if a seller offers a commission below a certain threshold (e.g., 2%), the rebate may be reduced or eliminated to ensure the Partner Agent receives their minimum service fee.

5. Partner Agents Our Partner Agents are independent third-party professionals. They are not employees or agents of Flat Fee YYJ.

  • No Liability: Flat Fee YYJ is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Partner Agent.
  • Independent Judgment: You are not obligated to work with the Partner Agent we introduce. You should exercise your own judgment and due diligence before entering into an agreement with any real estate professional.

6. User Eligibility By using this Site, you represent that you are at least 19 years of age (the age of majority in British Columbia) and are capable of entering into a binding contract.

7. Limitation of Liability To the fullest extent permitted by applicable law, Flat Fee YYJ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

  • Your access to or use of (or inability to access or use) the Site.
  • Your dealings with any Partner Agent or third-party service provider introduced through the Site.
  • Any inaccuracies in the calculator tools or content provided on the Site.

8. Intellectual Property The content, design, graphics, and “Savings Calculator” tool on this Site are owned by or licensed to Flat Fee YYJ and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

9. Governing Law These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Victoria, British Columbia.

10. Modifications We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site constitutes your acceptance of the revised Terms.
